1. Agreement to Terms

By accessing or using PartyUnlocked ("the Service"), available at partyunlocked.com, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service, including event creators ("Hosts") and event guests ("Guests").

2. Description of Service

PartyUnlocked provides an online platform for creating and managing event invitations. Our services include:

• Event page creation with customizable themes and fonts
• Optional event password protection
• RSVP collection and guest management
• Guest playlist collaboration via iTunes search
• Digital guestbook for guest messages
• Gift wishlist with guest claiming
• Dietary and accommodation preference collection
• Food and drink menu management with per-course guest choices
• Interactive quiz for guests
• Drag-and-drop seating chart
• Printable personalised invitation cards
• Email notifications to the host on new RSVPs

Some features are available on all plans. Others require a Premium upgrade. See Section 3 for details.

3. Free and Premium Plans

Free Plan

Free accounts may create events with up to 25 guests and have access to core features including RSVP collection, music playlists, customizable themes, and printable invitation cards.

Premium Plan

Premium events are unlocked for a one-time fee per event. Premium includes an increased guest limit of 300, plus access to food and drink menus, the digital guestbook, and the gift wishlist. Pricing is displayed at checkout and on our pricing page.

Credits

Credits may be purchased and applied at event creation to automatically upgrade that event to Premium. Credits are non-transferable and tied to the account that purchased them.

Payments

All payments are processed securely by LemonSqueezy. By completing a purchase, you also agree to LemonSqueezy's terms of service. PartyUnlocked does not store your payment card details.

Refunds

Refund requests are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at [email protected] within 14 days of purchase. Refunds are not guaranteed once a Premium event has been actively used.

4. User Accounts

Account Creation

To create events, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

5. User Content

Your Content

You retain ownership of content you submit to the Service, including event details, guest messages, song requests, wishlist items, quiz questions, cover images, and any other information you or your guests provide ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely in connection with providing the Service.

Guest Data

As a Host, you are responsible for any personal data you collect from guests through the Service, including names, headcounts, dietary requirements, and food or drink choices. You must handle this data in accordance with applicable privacy laws and must not use it for purposes beyond managing your event.

Content Restrictions

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes on any patent, trademark, copyright, or other intellectual property rights
• Contains viruses, malware, or other harmful code
• Violates the privacy or publicity rights of any third party
• Is spam, advertising, or promotional material without our consent
• Impersonates any person or entity

Content Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems or software to extract data from the Service
• Create events for fraudulent or misleading purposes
• Harass, abuse, or harm other users
• Circumvent any security measures we implement

7. Event Hosts' Responsibilities

As an event Host, you are responsible for:

• The accuracy of event information you provide
• Managing your guest list and RSVPs
• Ensuring your event complies with all applicable laws
• Handling guest data in accordance with applicable privacy laws
• The conduct and content of your event page
• Setting an appropriate event password if you wish to restrict access to your event page

8. Third-Party Services

Our Service integrates with or relies on the following third-party services. Each has its own terms and privacy policy, and we are not responsible for their content or practices.

• iTunes / Apple Music — used to search for songs that guests and hosts can add to the event playlist
• LemonSqueezy — used to process payments for Premium upgrades and credit purchases
• Resend — used to deliver email notifications, such as RSVP alerts sent to hosts

Our Service may also include links to other third-party websites. We are not responsible for the content or practices of those sites.

9. Data Retention

Event data, including guest lists, RSVPs, messages, songs, and wishlist items, is retained for as long as the associated host account remains active. When an event is deleted by the host, all related data is permanently removed. When an account is closed, all associated events and data are deleted.

10. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of PartyUnlocked. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for the conduct of users or the accuracy of information provided by users. We do not guarantee that events created on our platform will occur or be successful.

Data Loss

We do not guarantee the preservation of any data stored on the Service. Data may be lost due to hardware failure, software bugs, accidental deletion, infrastructure outages, or other unforeseen circumstances. We do not operate a guaranteed backup service. You are strongly encouraged to export and save copies of your important data regularly. Guest lists can be exported as a CSV file from your admin dashboard at any time.

Security Incidents

While we implement reasonable technical and organisational measures to protect data stored on the Service, no system connected to the internet is completely secure. We cannot guarantee that unauthorised third parties will never be able to defeat our security measures. In the event of a security breach affecting your data, we will make reasonable efforts to notify affected users as required by applicable law, but we disclaim all liability for any damages resulting from such an incident.

Service Availability and Bugs

We do not warrant that the Service will be available at any particular time or that it will function without errors, interruptions, or defects. Features may behave unexpectedly, produce incorrect results, or become temporarily unavailable. We are not liable for any loss or inconvenience caused by service downtime, bugs, or incorrect behaviour of any feature.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTYUNLOCKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM DATA LOSS CAUSED BY BUGS, INFRASTRUCTURE FAILURES, OR ACCIDENTAL DELETION, AND DAMAGES ARISING FROM UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA AS A RESULT OF A SECURITY BREACH.

IN ALL CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO PARTYUNLOCKED IN THE TWELVE MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENT (INCLUDING FREE PLAN USERS), OUR TOTAL LIABILITY SHALL NOT EXCEED $10 USD.

13. Force Majeure

PartyUnlocked shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond our reasonable control. This includes, but is not limited to:

• Failures or outages of third-party hosting, infrastructure, or cloud providers
• Failures of third-party services we depend on, including payment processors and email delivery services
• Cyberattacks, distributed denial-of-service attacks, or other malicious acts by third parties
• Natural disasters, fire, flood, or other acts of nature
• Government actions, laws, or regulations
• Internet or telecommunications failures outside our control

In such circumstances, our obligations will be suspended for the duration of the event. We will make reasonable efforts to restore the Service as quickly as possible.

14. Indemnification

You agree to indemnify and hold harmless PartyUnlocked and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PartyUnlocked operates, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
